1. Introduction
These Terms of Service ("Terms") govern your use of the AirTalk website airtalk.pro and the AirTalk Pro web application app.airtalk.pro (collectively, the "Services"), operated by AirTalk ("we," "us," or "our").
By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
These Terms are governed by Polish law and comply with the Act on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną), the Consumer Rights Act, and the General Data Protection Regulation (GDPR).
2. Service Provider

3. Definitions
- Services: The AirTalk website and the AirTalk Pro web application.
- User: Any person who accesses or uses our Services.
- Account: A registered user profile created through Google Sign-In.
- Consumer: A natural person using the Services for purposes outside their trade, business, or profession.
- Premium Features: Paid features planned for future availability through subscription plans.
- Content: All materials provided through the Services, including exercises, vocabulary, lessons, and learning materials.
- User Data: Personal learning data created by users, such as Word Bank entries and progress records.
4. Account Registration
4.1 Registration Requirements
To use the AirTalk Pro application, you must:
- Be at least 16 years old, or have parental/guardian consent if younger
- Create an account using Google Sign-In (OAuth)
- Provide accurate information
We do not store passwords. Authentication is handled securely through Google.
4.2 Account Responsibilities
You are responsible for:
- Maintaining the security of your Google account
- All activities that occur under your account
- Not sharing your account access with others
4.3 Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms
- Engage in abusive behavior
- Attempt to circumvent security measures
- Remain inactive for an extended period (with prior notice)
5. Description of Services
5.1 Free Features
The AirTalk Pro application provides free access to:
- Basic vocabulary exercises
- Grammar drills
- Progress tracking
- Personal Word Bank for saving vocabulary
5.2 Premium Features (Planned)
Future premium subscription plans may include:
- Advanced learning modules
- Extended exercise libraries
- Priority support
- Additional features as specified in the subscription plan
5.3 Enterprise/Classroom Features
For users who are part of an organization or classroom:
- Teachers may assign lessons and tasks to students
- Assigned content is visible within your account
- Your learning progress may be visible to your assigned teacher
5.4 Live Lessons (Language School)
AirTalk Language School offers live lessons with qualified teachers. These lessons are:
- Booked and arranged directly with the school (not through the app)
- Subject to separate arrangements regarding scheduling, cancellation, and payment

6. Technical Requirements
To use our Services effectively, you need:
- A device (computer, tablet, or smartphone) with internet access
- A modern web browser (Chrome, Firefox, Safari, or Edge - current versions)
- JavaScript and cookies enabled
- Minimum internet connection: 1 Mbps (5 Mbps recommended for video content)
We are not liable for issues arising from outdated browsers, insufficient internet connection, or incompatible devices.
7. User Obligations
7.1 Acceptable Use
You agree to:
- Use the Services only for personal, educational purposes
- Respect intellectual property rights
- Treat other users and staff with respect
7.2 Prohibited Conduct
You must not:
- Share your account credentials
- Attempt to access other users' accounts
- Copy, distribute, or sell our Content
- Use automated tools to scrape or extract data
- Reverse engineer or decompile the application
- Upload malicious code or interfere with the Services
- Use the Services for any illegal purpose
8. Intellectual Property
8.1 Our Content
All Content provided through the Services (exercises, vocabulary lists, images, audio, text, and software) is owned by AirTalk or our licensors and is protected by copyright and other intellectual property laws.
8.2 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and Content for personal, non-commercial educational purposes only.
8.3 Your Data
You retain ownership of your personal User Data (such as Word Bank entries). By using our Services, you grant us a license to store and process this data solely to provide you with the Services.
9. Payments and Subscriptions
9.1 Free Tier
Basic features are available free of charge.
9.2 Premium Subscriptions
Premium subscription plans are planned for a future release. When available:
- Pricing and features will be displayed before purchase
- Subscriptions will renew automatically unless cancelled
- You will authorize us to charge your payment method at the start of each billing cycle
- Price changes will be communicated 30 days in advance
9.3 Cancellation
Once premium subscriptions are available, you may cancel your subscription at any time through your account settings. Access will continue until the end of the current billing period.
10. Right of Withdrawal (Consumers)
10.1 Your Right
If you are a Consumer, you have the right to withdraw from a purchase within 14 days without giving any reason.
10.2 Digital Content Exception
By creating an account and accessing Premium digital content immediately, you acknowledge that:
- You expressly consent to the immediate provision of digital content
- You acknowledge that you lose your right of withdrawal once digital content delivery has begun
10.3 How to Withdraw
To exercise your withdrawal right (where applicable), contact us at airtalk.school@gmail.com with a clear statement of your decision.
10.4 Refunds
If withdrawal is valid, we will refund you within 14 days using the same payment method.
11. Liability
11.1 Service Availability
We strive to maintain continuous availability of our Services but do not guarantee 100% uptime. We may temporarily suspend Services for maintenance, updates, or circumstances beyond our control.
11.2 Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for issues caused by your equipment, internet connection, or third-party services
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
11.3 Consumer Rights
Nothing in these Terms limits your statutory rights as a Consumer under Polish and EU law.
12. Complaints
12.1 How to Complain

- Description of the issue
- Your preferred resolution
12.2 Response Time
We will respond to complaints within 14 days. If we do not respond within this period, the complaint is deemed accepted.
12.3 Dispute Resolution
If you are a Consumer and we cannot resolve your complaint, you may:
- Contact the Consumer Arbitration Court at your local Trade Inspection Inspectorate
- Contact the President of the Office of Competition and Consumer Protection (UOKiK) for further assistance
13. Privacy
Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data.
14. Changes to Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last Updated" date
- We will notify registered users via email at least 14 days before changes take effect
- Continued use after the effective date constitutes acceptance
If you do not agree with the new Terms, you may terminate your account before they take effect.
15. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland. For Consumers, disputes may be brought before the courts of your place of residence. For business users, the courts of Poland have exclusive jurisdiction.
